One of the common questions that artists and bands always ask is, “How can I copyright my music and secure that my band is the only one allowed to use that name?”

How can you ensure that no one else will use your name—your brand?

We decided to ask attorney Cheryl Hodgson a few questions.  She has more than 25 years of experience in trademark and copyright legal matters. Cheryl has represented many groups in registering names, and litigated a number of disputes involving ownership of band names.  Cheryl also has a blog called “BRANDAIDE.”  We hope this interview will give bands a better idea of how to protect their cherished name and brand. 


LoudTrax.com Before the Internet, this was already a tricky question.  Today, this is even more complicated.  How can a band secure that they are the only ones using a particular name?

Hodgson  The two most important actions steps are:
1.    Reach an agreement as to who owns the name and document it in writing.
2.    Register the name in the name of the partnership or business entity which the group forms, or the individual(s) who are to control the name.

Groups fail to register their name, because they feel they cannot afford it in the early stages.  Secondly, they do not have a clear agreement has to who is the owner of the name.  Both often cause problems down the road. 

A few years ago, the founders of the largest Mexican group in America were jailed in Mexico for two months for attempting to perform in Mexico under their own name.  A former associate had registered the name in Mexico before they did, and when they fired him, he had them put in the slammer!

A lead singer and writer of a famous Canadian group from the 60’s cannot perform in the U.S., because a former band member registered the name in the U.S.  The former member and owner of the name in the U.S. tours regularly now in casinos, but misleads the public because none of the known original members are in the group.  The older group members do not want to spend $100,000 or more to fight to get the name back in the U.S.


LoudTrax.com  Does having the “.com” mean a band owns that name?

Hodgson  NO!  A domain is an address for a website on the Internet.  Unless the name is used for advertising and marketing of specific goods and services, there are no trademark rights created by registering the domain.  A domain will not prevent someone else from registering the band name as a federal trademark with the proper government agency, such as the U.S. Trademark Office.

 

LoudTrax.com  Do you recommend that artists file their band name as a brand with the trademark bureau?

Hodgson  Yes, in the U.S., registration is with the U.S. Trademark Office in Washington, D.C.  The filing fee is $325 per class, plus legal fees.    The classes most relevant to groups are those for recordings, merchandise, and live performance.  If cost is a factor, pick one, and choose live performances.  In Canada, there is no classification system, so filing the descriptions is a bit easier.  

In a case currently pending in Chicago, the indie label registered the group name as its own (after the group had already recorded 5 albums on their own).  The group is now distributed by a major label in the U.S.

The indie label registered only for merchandise and recordings, not live performances.  The judge issued an injunction allowing the original group to continue to perform, but they cannot sell records or merchandise while the case is pending.  I believe the judge is wrong, but until the case is tried, both groups are performing and it is a disaster for their careers. 

LoudTrax.com  When you file in one country, does that mean it is valid around the world?  Should bands register their brand in several territories? 

Hodgson  The U.S. recognizes “common law” rights based upon use, but majority of the world does not.  The first to file is the owner!  Even in the U.S., possession is 9/10 of the law.    The territory where the group is based and performs is the most important.  If a group goes between two countries such as U.S. and Canada, registering in both can be important.

 

LoudTrax.com  This sounds like a lot of work for an indie band to handle.  It can also get rather expensive, correct?

Hodgson  Expensive guitars are sexier and more fun than legal fees when a group is first starting out.  However, protecting the band name is like recording the deed to one’s home.  While it can seem expensive, think about the consequences of not doing so.  Being locked out of an important territory, or having to pay 100 times the registration cost to get back rights taken by a third party, makes it worth every penny. 

An expert can do the job fairly easily and some may work with the group on creating affordable options.

 

LoudTrax.com  What kind of proof can be helpful in proving that you were in fact the first artist to use a certain band name?

Hodgson  Advertising for show dates are vital.  Keep an archive of early flyers, posters, newspapers, Internet ads for shows, and early invoices for merchandise sales.  Albums usually have a clear release date online.  It’s amazing how many groups cannot find copies of their recording agreements, or prove much of what they did in the early days, making it difficult to prove rights down the road.

 

LoudTrax.com  If you trademark the band name that does not automatically mean you trademark the band’s logo?

Hodgson  Correct.  The logo is separate from the words, even if included.  If faced between choosing one over the other, always go for the words alone first.  Registration of the words alone provides broader protection. 

Registration of a copyright for a logo containing great artistic design elements can be an inexpensive alternative to a second registration for the logo.  It is less expensive ($35 in the U.S) and any reproduction would violate copyright in the artwork.  It is not a substitute for a trademark registration for the name for goods and services pertaining to bands.

 

LoudTrax.com  How about if the band or artist name is your own actual name?  Are the rules different?

Hodgson  The rules are the same.  In either case, in order to register, one must follow proper rules of usage in marketing and promotional materials.  The name of the individual should be used in connection with the sale and advertising of specific services.  Registration of an individual’s name can be very important because of the Internet.  Well known authors’ names get plastered on sites, or in domains, as a sort of “implied endorsement.”  A new comer tries to sell their product by using the well known individual’s name to drive traffic to their site.  Without a registration, this “policing” becomes more difficult and expensive.

 

LoudTrax.com  What other tips can you give artists who wish to secure their name?

Hodgson  Do not underestimate the added psychological value of having a registration in place for either a band or individual. 

It is common to see fake ringtone sites with a band’s name, or use of a band or individual’s name as part of an infringing domain.  In the case of ringtones, I have seen midi files of popular songs (not the original master), and the publisher ignores it.  If the group does not own the master or the song, the only remedy of the group is to assert rights based upon infringement of their name.   This is where a registration is invaluable.

In the case of use of the name as part of someone else’s domain, sending  a letter with a copy of the registration will often get a cybersquatter to “cough it up” with little or no resistance.  When caught with their fingers in the cookie jar, they hand over the cookie.

After the success of “Hello Master”, expectations were high for the new offering “Prior To the Fire”, which was produced by David Schiffman (Mars Volta, Nine Inch Nails).

The track “Trapped In Space and Time”, tells you straight away that the band is back with a heavier more aggressive sound!  Cool.   Although their influences are noticeable (early Metallica, Early Sabbath, etc….), the band has continued in the evolution of what is becoming their own distinct sound.

Blast the stereo (or iPod, ....) with "Ladykiller", and you really want to crack this up and get the air drums going!  It is in your face, aggressive, drums pounding.  Yes!  This album is filled with killer riffs, catchy melodies, and great drumming – especially nice rhythm on “It Baffles the Mind”.

There are no weak trax on this album.  9/10.

ZAK Stevens (Circle II Circle / Savatage / Machines of Grace) Interview

Zak Stevens is one of Metal's most respected lead vocalists.  He took on the role of replacing the legend Jon Oliva with great conviction and power.  Since his days in Savatage , Zak has been fronting his own band, Circle II Circle and recently Machines of Grace.  Circle II Circle are currently recording their 5th album “Consequence of Power”.  It is a concept album and due out in the of Fall 2010.

LoudTrax.com The first 4 albums each kind of have their own sound.  What can we expect from this new album in terms of sound and general vibe?

Zak Stevens It will be different. Much like the other albums offer their own differences in sound.  In my view some of the new stuff is revisiting the “traditional” rock guitar sounds and song arrangements that will take us back a chapter or two in time while others are
more basic in scheme.  My role, as with all our records, is to make the overall picture appeal to today’s rock listener from a vocal standpoint with the best effort I can and what will hopefully result in hook after hook coming at you full blast.
 
LoudTrax.com There were some line-up changes on this record.  Tell us about them.

Zak Stevens Only one of the original four was added and that is John “Oz” Osborn on drums and old friend of our who has toured with us before our former drummer Tom Drennan, who did a great job for us through the stretch, but it just didn’t work out in the end more due to geographic concerns,.  Now Circle II Circle is basically the “core” band; myself on vocals,  bassist, keyboardist, and vocalist Mitch Stewart, drums with Oz, guitars and lead guitars by Andy Lee.  All we really need now in a four-piece for the Circle II Circle sound with one of the best guitarists out there playing the type of music he does, which basically every style.


LoudTrax.com What is the “concept” and main theme behind this new album?

Zak Stevens It’s a complicated and very deep concept about things happening that we don’t really have much control of, and about a character who is centrally involved, against his will, into this cycle of madness, power, and a lot of crazy things.  More on the story later on as things come more together with the music....

LoudTrax.com “Consequence of Power” is a concept album.  Do you have your own favorite concept album or any concept albums that inspired you on this one?

Zak Stevens Well the nature of the concept on “Consequence of Power” talks  more from a street level then from some giant conglomerate force, so the wealth and power we see are from the mass of money coming from private firms into the hands of let’s say the blue collar man.  It’s harder to track from a law enforcement standpoint.  I mean I have to admit I’m from a time where Queensryche’s “Operation Mindcrime” was a huge influence on me.  I was learning big time about how the be successful in music and that album was just sort of overwhelming at the time.  I think that’s gotten a hold on me but it’s hard to say how it will affect this album, if any.  But I guess we will see...

LoudTrax.com You performed back-up vocals with Trans-Siberian Orchestra on their last album Night Castle, and, have the Machines of Grace album out (which will be released in Canada on April 20), and, are currently recording the new Circle II Circle album.  Do you find you have to wear different “hats” for each project to maintain the uniqueness of each?

Zak Stevens No, not really.  They’re all different styles but when you know how to sing you just have to make the adjustment from style to style.  The Machines Of Grace  is the most comfortable for me because it was the stuff I’ve been working on the longest.  The other stuff like Savatage and Circle II Circle and TSO is more of an “applied” concept of learning to adjust vocally, that works well but that’s what that is.  The Machines Of Grace stuff is the first I had to write completely alone, from the heart, etc. so it’s the most comfortable ‘cause it’s been around the longest.  See the trend here?  Ha Ha...

LoudTrax.com If you take a look at the projects that are currently based on the Savatage foundation,  TSO, Chris Caffery, Jon Oliva’s Pain, Circle II Circle, Machines of Grace, etc…  Each one is obtaining its own successes, and many fans hope for a Savatage reunion tour and new album.  How important is it to you guys to do a reunion, especially now, when the interest level would be at an all time high?

Zak Stevens Well my hope is just that the interest and momentum over a Savatage reunion would overcome speculation and decision making within the organization and just react to the reality of the capital and monetary demand for such a thing and let’s get out there and do it. That’s always been my take on the subject, period.

LoudTrax.com Let's talk about the Machines Of Grace project with Jeff Plate (Savatage, TSO and Metal Church).  This is a project you worked on with Jeff about 20 years ago which was originally called Wicked Witch.   It’s cool to see successful artists release music for the pure pleasure of it.  Is Machines Of Grace something you plan on building on, or was it simply a one-off?  A way to get those songs on record?

 
Zak Stevens I would say a big part of it was getting our favorite WickedWitch songs on a “real” record to hear them in their own power and glory.  We had to change the name of the band due to a legal dispute, but we overcame that stuff with MOG.  And truthfully I must tell you when we walk up there to perform “MOG” songs, I really think and get fired up to go on stage and perform  “Wicked Witch” songs, because that’s what they really are to me, and what they really meant to me, and that is the times we played and lived in.  And it was an unbelievable experience up in New England that I wish I could do again....Maybe we are.....

LoudTrax.com I saw that you have European tour dates for Machines Of Grace planned.    Are you guys playing on festivals or doing your own headlining gigs?  Where can fans find the tour dates?

Zak Stevens Well I don’t have details on that part yet but let’s just say we’re working on a lot of different things for this summer and fall....

LoudTrax.com There is a Circle II Circle tour planned for USA, South America and Europe.  Will that be in time for the Fall release of “Consequence of Power”?   What else can you tell us about the C II C tour?

Zak Stevens Well we’re going to most likely start in Texas do about 5 shows or so then and then go out west like Los Angeles, and Phoenix, AZ, and New Mexico.  We’re going all over the Midwest, and back through the South so it should be a great US Tour with some great gigs for us.  We’re going to Europe too on a pretty extensive run, and then devote a few weeks trying to expand from Brazil to Argentina and maybe Chili and more places like that over in South America.

Who's the best Iron Maiden opening act?


With the announcement of the upcoming Iron Maiden tour with very special guests, Dream Theater.  I started to think about, what opening acts were my favorite to open for the british legends.

Up until now, seeing Anthrax support the "Persistence of Time" album in the opening slot for Maiden on the No Prayer for the Dying tour was my favorite.  Metallica and Helloween also get a vote.

However, now that they announced Dream Theater, I think a new number 1 has emerged.  It's not that Dream Theater is necessarily better than those other bands, it's the fact that they are at the prime of their career having released one of their best albums to date in Black Clouds & Silver Lining.

What band do you think is the best to open for Iron Maiden?

Boston's thrash / death metal band Revocation unleashed their 2nd album and first on Relapse Records in Sept 2009.  They refer to their style as DOUCHE THRASH.  We'll need a few more bands in this genre to create it's own section on LoudTrax.com! 

The very talented trio is technical and tight.   You can hear the Megadeth, Metallica and Slayer inspirations.  However the band is not just another thrash / death metal band.  They have carved out their own sound that contains several time changes, syncho-pated rhythms and good old rock guitar solos which all blends together beautifully.  Some great guitar solos on this including some cool finger tapping.  "Existence is Futile" keeps the interest level high with no weak songs, solid and interesting from start to finish. 

The lead off track, and featured free download, "Enter the Hall" is a perfect intro and sets the tone for this modern classic.  "Deathonomics" is a head banging thrash metal anthem, with a cool little jazzy outbreak, emerging back with heavy, grooving riffs.  The track "Leviathan Awaits" has some great harmonized riffs which bring us back to the heyday of metal. 

Wish i had discovered these guys before!
